2. These terms and your rights
These terms explain how you may use our website and the conditions that apply when ordering from us.
Please read them alongside the product description and our Shipping Policy, Refund Policy and, where applicable, Pre-order Cancellation Policy. Relevant information provided before you order forms part of your contract.
The consumer rights described here apply when you purchase wholly or mainly for purposes outside your trade, business, craft or profession.
Nothing in these terms or our other policies excludes or limits your statutory rights. This includes your rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013, where applicable.
3. Placing and accepting orders
Please check the products, quantities, prices, delivery address and contact details before placing your order. You must be authorised to use the payment method you provide.
By submitting an order, you offer to purchase the items under the terms shown before checkout, including any disclosed payment schedule.
A binding contract is formed when we send you an order confirmation accepting your order. If a message only acknowledges receipt and does not accept your order, we will make that clear.
Before accepting an order, we may decline it for a reasonable reason, such as unavailable stock, unsuccessful payment, a delivery restriction or reasonable grounds to suspect fraud. We will inform you and promptly refund any payment taken for an order we do not accept.
Once an order is accepted, we will honour the agreed terms. We will not increase its price or substitute a materially different product without your agreement. Any cancellation by us must be permitted by law and will not remove your rights to a refund or any other remedy.
Contact us promptly if you notice an error in your order. We will help where possible, although changes may not be possible after dispatch.
4. Products and trading cards
We are responsible for supplying products that match their description, are of satisfactory quality and are fit for any particular purpose you make known to us and we agree to.
Please read the listing carefully, including the edition, language, quantity, format, condition and whether the item is sealed, opened, graded or sold as a single card.
Where a photograph is illustrative rather than an image of the specific item, the listing should make this clear. Minor differences in screen colours or packaging do not remove your right to receive the product described.
Sealed packs and boxes may contain randomly selected cards. Unless expressly stated in the listing, we do not guarantee a particular player, team, card, rarity, autograph, grading outcome or resale value.
Collectable values may change. We do not promise that a purchase will retain or increase its value.
These statements do not limit your rights if an item is faulty, counterfeit, incomplete or not as described.
5. Prices and payment
The applicable price and currency are displayed when you order. Prices include VAT where applicable. Delivery charges and other applicable charges payable to us will be shown before you complete your purchase.
Available payment methods are displayed at checkout.
For pre-orders or other purchases with staged payments, the amount payable immediately and the timing or basis of any later payment will be disclosed before you order.
We may change prices for future purchases. This does not change the agreed price of an accepted order.
If we discover a pricing or description error before accepting your order, we will explain it and let you decide whether to proceed on the corrected terms or cancel. We will not take an additional payment without your agreement.
Errors discovered after acceptance will be dealt with in accordance with your contract and applicable law.
6. Pre-orders
A pre-order is an order for a product that is not yet available for dispatch.
Any estimated release, availability or dispatch information will be provided before purchase. A manufacturer’s release date is not necessarily the date the product will arrive with us or be delivered to you.
If an estimate changes, we will provide an update and explain the available cancellation and refund options. A delay does not automatically remove your cancellation rights or extend an agreed delivery deadline.
If we cannot supply an item, we will notify you and refund the amount paid for it. Your other statutory rights remain unaffected.
Pre-orders are not automatically non-refundable. Eligible online purchases remain subject to statutory cancellation rights.
Please see our Pre-order Cancellation Policy and Refund Policy for further details.
7. Dispatch and delivery
For in-stock items, we aim to dispatch within 48 hours, excluding weekends and UK bank holidays. This is a dispatch target, not a promise of delivery within 48 hours. Pre-orders have separate availability and dispatch arrangements.
Available destinations, delivery options and charges are shown at checkout. Please see our Shipping Policy for further information.
For UK consumer purchases, we will deliver within the agreed period or, where no different period has been agreed, within 30 days of the contract being made.
If delivery is delayed, contact us. We will investigate and explain the next steps. Your legal rights may include setting an appropriate further delivery deadline or cancelling for a refund. In some circumstances, including where an essential agreed delivery date is missed, you may cancel without allowing extra time.
Goods remain our responsibility until they are physically received by you or someone you nominate. A different legal rule may apply if you independently appoint a carrier that we did not offer.
Contact us if an order is lost, damaged or incorrect. We will deal with the issue and any carrier investigation; your rights against us do not depend on you obtaining compensation from the carrier.
8. Live card breaks and other services
Where we offer a live card break, the listing will explain what you are buying, the allocation rules, what you will receive and any relevant timing.
Random contents do not guarantee particular cards or a minimum resale value unless expressly promised.
Cancellation rights depend on what is actually being supplied. A purchase involving physical cards is not automatically treated as a service-only contract.
Where the law requires your express request to start a service during a cancellation period, we will obtain it separately. Any proportionate charge for work completed, or loss of a cancellation right after full performance, applies only where all relevant legal conditions have been met.
Simply accepting these terms, watching a stream or having packs opened does not, by itself, waive statutory rights. Rights relating to any goods supplied remain applicable.
9. Changing your mind and cancelling
For eligible UK online purchases of goods, you may cancel from the time you place your order until 14 days after you or your nominated recipient receives the goods. Where one order is delivered in separate parts, the period normally runs from receipt of the last item.
Tell us clearly that you wish to cancel by email, telephone or post using the contact details above. Include your order number if available. You do not need our prior approval to exercise a statutory cancellation right.
If you have received the goods, send them back within 14 days of telling us you are cancelling. For a change-of-mind return, you normally pay the direct return postage cost unless we agree otherwise.
You may inspect goods as you reasonably could in a shop. Where permitted by law, we may deduct an amount reflecting loss in value caused by handling beyond what is necessary to establish their nature, characteristics and functioning.
Opening trading-card packs or boxes may reduce their value, but does not automatically remove a statutory cancellation right. This does not limit your rights concerning faulty or misdescribed goods.
For an eligible cancellation of an entire order, we refund the goods and the cost of our basic standard outbound delivery. Any extra paid for an upgraded delivery service need not be refunded.
Where goods must be returned, we normally refund within 14 days of receiving them back or receiving evidence that you sent them, whichever is earlier. If no goods need to be returned, we refund within 14 days of your cancellation notice.
Refunds use the original payment method unless you expressly agree otherwise, without a refund fee.
Any statutory exceptions apply only where their legal conditions are satisfied. Sale items, pre-orders and collectables are not automatically excluded.
Our Refund Policy contains further details and an optional cancellation form.
10. Faulty, damaged or incorrect goods
Your rights concerning faulty, damaged, incomplete or misdescribed goods are separate from change-of-mind cancellation rights.
Depending on the circumstances, you may be entitled to reject goods, obtain a repair or replacement, receive a price reduction or obtain a refund.
Please contact us so we can investigate and arrange an appropriate remedy. Photographs or other supporting information may help, but we will not make them an unreasonable condition of exercising your rights.
We will cover reasonable return costs where required by law. We will not require you to pursue the manufacturer instead of exercising your rights against us.
11. Website use and accounts
Please use the website lawfully and provide accurate information when ordering or contacting us.
You must not use the website for fraud, introduce malicious software, attempt unauthorised access or interfere with its security or operation.
If you create an account, keep your login details secure and contact us if you suspect unauthorised use.
We may restrict access where reasonably necessary to address misuse or a security risk. This will not remove your rights concerning existing purchases, refunds or complaints.
Website content belongs to us or the relevant rights holders. You may use it for normal personal browsing and shopping. Other uses require permission unless permitted by law.
12. Privacy
Our Privacy Policy explains how personal information is collected, used and shared, including the involvement of Shopify and other service providers.
Accepting these terms does not, by itself, constitute consent to marketing or to cookies that require consent. Relevant choices are handled separately.
13. Our responsibility
We are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill. Loss is foreseeable if it is an obvious consequence or was something both parties knew could happen when the contract was made.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or anything else that cannot lawfully be excluded or limited.
If an event outside our reasonable control affects an order, we will contact you and take reasonable steps to reduce its impact. This does not remove your delivery, cancellation, refund or other statutory rights.
14. Complaints and disputes
Please send complaints to sales@jakesbreaks.co.uk, call 0115 870 0053 or write to our business address above. Include your order number and a description of the problem if available.
We will investigate and seek to resolve the complaint fairly. Where required by law, we will provide information about alternative dispute resolution and explain whether we will participate.
These terms are governed by the law of England and Wales. This does not take away any mandatory consumer protections you have under the law of the country where you live.
UK consumers may bring proceedings in the courts of the part of the UK where they live. Nothing in these terms restricts any other court rights you have under applicable law.
15. Changes to these terms
We may update these terms for future purchases. The version provided when you place an order applies to that order unless a change is required by law or expressly agreed with you.
If a provision is found to be unlawful or unenforceable, the remaining provisions continue to apply where legally possible. An invalid provision does not remove your statutory rights.
For questions about these terms, contact sales@jakesbreaks.co.uk.
