Jakes Breaks Privacy Policy

Last updated: 11 October 2026

1 Who we are and how to contact us

Jakes Breaks Ltd, trading as Jake’s Breaks, operates www.jakesbreaks.co.uk. This policy explains how we collect, use and share personal information when you browse our website, place an order or pre-order, use our online services or contact us.

Jakes Breaks Ltd is the data controller for the information we use to run our business. This means we decide why and how that information is used. We handle personal information under applicable data protection law, including the UK General Data Protection Regulation and the Data Protection Act 2018, as amended.

  • Telephone: 01158 700 053

  • WhatsApp: 07457 411724

  • Post: Jakes Breaks Ltd, 56 High Road, Beeston, Nottingham, NG9 2JP, United Kingdom

2 Personal information we collect

The information involved depends on the services you use. It may include:

  • Contact details: your name, email address, telephone number, billing address and delivery address.

  • Orders and transactions: products purchased or pre-ordered, order references, payment method and confirmation, delivery instructions, tracking details, returns, refunds and correspondence about an order.

  • Account and shopping information: account identifiers, saved addresses, preferences, order history, basket contents and wishlists.

  • Enquiries and submissions: messages you send us, information needed to resolve a query or complaint, and reviews or other content you choose to submit.

  • Marketing and notification preferences: subscriptions, requests for stock alerts, consent choices and opt-out records.

  • Technical and usage information: IP address, browser and device details, approximate location inferred from an IP address, pages and products viewed, and interactions with our website, messages or advertising where collection is permitted.

Payments are processed through Shopify and the payment providers involved in your transaction. They process the payment information you provide; we receive the transaction information needed to administer your order and any refund. Please do not send full payment card details or unnecessary sensitive information through email, social media or contact forms.

3 Where information comes from

We receive information directly from you when you shop, create an account, request a service or contact us. Our website and connected services also collect technical information using cookies and similar technologies, subject to the applicable rules and your choices.

We receive information from Shopify, payment providers, delivery services and providers supporting the features you use. If you buy through a marketplace or social commerce platform, we may receive the order and contact information needed to fulfil and support that purchase. Those platforms also handle information under their own privacy notices.

4 How we use information and our legal bases

  • Orders, pre-orders and requested services: to take payments, fulfil purchases, arrange delivery or collection, provide requested account features and manage returns or refunds. We rely on performing our contract with you or taking steps you request before entering a contract.

  • Customer service: to answer enquiries and support your purchases. We rely on a contract where relevant, or our legitimate interest in providing responsive customer service.

  • Records and legal obligations: to maintain required accounting and tax records and comply with applicable legal requirements. We rely on compliance with legal obligations.

  • Security and fraud prevention: to protect customers, transactions, accounts and our business, and investigate misuse. We rely on our legitimate interests in preventing fraud and protecting our services, and legal obligations where applicable.

  • Service operation and improvement: to maintain our store, understand how it is used and improve its features. We rely on our legitimate interest in operating an effective business, with consent where required for tracking or related processing.

  • Marketing and advertising: to communicate about products and offers and support relevant advertising. We rely on consent where required, or legitimate interests where a lawful marketing exception applies, as explained below.

  • Complaints and legal claims: to investigate concerns, resolve disputes and establish, exercise or defend legal rights. We rely on legal obligations where applicable and our legitimate interest in resolving disputes fairly.

When relying on legitimate interests, we consider the necessity of the processing and your interests, rights and freedoms. Information necessary to complete an order is not optional: without the relevant payment, contact or delivery information, we may be unable to process or deliver your purchase. Marketing consent is not a condition of buying from us.

5 Marketing and product notifications

Where we send marketing emails or texts to individuals, we do so with consent or under the permitted existing-customer exception for our own similar products and services. That exception requires an opportunity to opt out when details are collected and in each subsequent marketing message.

You can unsubscribe using the instructions in a marketing message or contact us at sales@jakesbreaks.co.uk. If you enable browser notifications, you can manage that permission through your browser or device. Withdrawing marketing permission does not stop essential messages about your order, payment, delivery, return or account.

If you request a stock or product-availability alert, we use your details to provide the requested notification. Additional marketing remains subject to the relevant marketing rules.

You can object to the use of your personal information for direct marketing at any time. This right is absolute and includes profiling related to direct marketing.

6 Cookies tracking and consent

Our website uses cookies and similar technologies to support features such as your shopping basket, checkout, security and preferences. Depending on the services enabled, other technologies support analytics, personalisation, social features or advertising.

Our store uses Shopify’s cookie consent tools. Where consent is required, we ask before using the relevant technologies. Advertising tracking requires consent. Any analytics used without consent must meet an applicable legal exception and its conditions.

You can accept or decline optional purposes and manage your choices through the cookie banner and cookie preferences controls available on our website. You may withdraw consent. Contact us if you need help locating the controls. Browser settings can also remove or block cookies, although blocking essential cookies may affect shopping functions.

For information about Shopify’s technologies, see its Cookie Policy. Regional data-sharing choices are explained in section 9.

7 Who we share information with

We share information where necessary for the purposes described in this policy, including with:

  • Shopify: to host and support our store, checkout and related services.

  • Payment, delivery and fulfilment providers: to process payments and refunds, arrange shipping or collection, and provide delivery support.

  • Providers supporting store features: such as pre-orders, wishlists, stock notifications, reviews, returns, invoicing and customer communications.

  • Technology and business service providers: including website support, hosting, accounting and record-management services.

  • Marketing and advertising providers: where the relevant activity is enabled and the required permissions are in place.

  • Professional advisers, authorities and other appropriate recipients: where necessary to comply with law, investigate fraud, resolve a dispute or protect legal rights.

The recipients depend on the service you use. Organisations processing information on our behalf must do so under appropriate contractual arrangements. Other organisations, including some payment providers and marketplaces, act as independent controllers for their own activities and explain these in their privacy notices. You can ask us for further information about the recipients relevant to your transaction or enquiry.

Information may also be disclosed in connection with a sale or reorganisation of our business where lawful and subject to appropriate safeguards. Reviews or other content you choose to publish may be visible to others. External websites and platforms have their own privacy policies.

8 Shopify and enhanced services

Our online store is hosted by Shopify. Information you provide, and information about your use of our store, is shared with Shopify to operate and improve the services.

Shopify Network Intelligence is enabled for our store. Shopify uses information about interactions with our store, other merchants and Shopify to provide enhanced services, including security, personalisation, service improvements and advertising. Shopify and other providers involved may process information in countries outside the UK.

Shopify may act as an independent controller for these enhanced services and for information it handles through your own relationship with services such as Shop and Shop Pay. Where consent is required, the relevant advertising and tracking activities depend on your consent.

Read Shopify’s Consumer Privacy Policy for details. You can use Shopify’s privacy portal to learn about access, deletion, advertising choices, withdrawal of consent and objections relating to information Shopify controls. You can contact us directly about information we control.

9 Regional data sharing choices

Some advertising-related uses of information may be described as “sale”, “sharing” or “targeted advertising” under applicable US state privacy laws. These terms do not necessarily mean information is exchanged for money.

Where applicable, you can exercise your choices through our data-sharing opt-out page or contact us for help. Shopify’s privacy tools recognise Global Privacy Control signals in regions where this opt-out feature applies. The signal applies to the associated browser or device and, where Shopify can associate it with an account, may be applied to that account. Other browser “Do Not Track” signals are not treated as a substitute for the privacy choices described here.

Depending on applicable law, you may have additional rights to access, correct, delete or receive information, use an authorised agent, or appeal a decision about a privacy request. To appeal, reply to our response or contact us using the details above. We will explain the applicable process and respond within the legal timescale. We will not unlawfully discriminate against you for exercising your rights.

10 Where information is stored and international transfers

Shopify currently lists the European Union as the data hosting location for our store. This does not mean that all personal information is processed exclusively within the EU. Shopify and other providers supporting our services may process information in other countries, including outside the UK and EU.

Where required, international transfers are supported by appropriate safeguards. These may include UK adequacy regulations recognising a destination’s protection, or approved contractual safeguards such as the UK International Data Transfer Agreement or UK Addendum to the European Commission’s Standard Contractual Clauses. Transfers subject to EEA law use the relevant EEA adequacy decisions or safeguards.

Contact us for information about the safeguards applying to your information and how to obtain a copy, subject to necessary redactions.

11 How long we keep information

We retain personal information only for as long as needed for its purpose, taking account of legal obligations and legitimate business needs. The relevant criteria include:

  • Orders and pre-orders: completing the transaction, fulfilling the purchase and handling returns, refunds, warranties or disputes. Pre-order information may be needed throughout the period before release and fulfilment.

  • Accounting and tax records: the legal retention requirements applying to the particular record.

  • Accounts and shopping features: whether the service remains in use, whether you request closure or deletion, and whether related records are needed for another lawful purpose.

  • Enquiries and complaints: resolving the issue and retaining a proportionate record of the outcome or any related claim.

  • Marketing: whether we still have a lawful basis to contact you. After an opt-out, a minimal suppression record may be retained so we can respect your choice.

  • Technical information: the purpose of the technology, its retention or expiry settings, and applicable legal requirements.

A legal obligation, investigation or ongoing dispute may require longer retention. When information is no longer needed, we delete it or anonymise it. You can ask us about the retention criteria applying to particular records.

12 Your data protection rights

Under UK data protection law, and subject to the conditions applying to each right, you can request access to your information, correction of inaccurate information, deletion, restriction of processing and data portability. You can withdraw consent at any time where we rely on it. Withdrawal does not affect processing that was lawful before withdrawal.

You can object to processing based on legitimate interests because of your particular circumstances. Your right to object to direct marketing is absolute.

Contact us using the details above; no particular form or legal wording is required. We may reasonably need to verify your identity or the authority of someone acting for you. If you have concerns about an automated decision affecting you, contact us to request an explanation or review, including any safeguards available under applicable law.

We respond without undue delay, normally within one month. Where the law permits additional time or requires information needed to verify or clarify a request, we will explain the applicable timescale. Requests are normally free. If a legal exception prevents us from fulfilling all or part of a request, we will explain our decision and how you can challenge it.

13 Children and young people

We recognise that trading cards and collectables may appeal to children and young people. Children have data protection rights too. Where we handle a child’s information, we must take their interests into account and explain our use of information in language they can understand.

If you are concerned that a child has provided information that should not have been collected, please contact us. We will investigate and take appropriate action. A parent or guardian can contact us on a child’s behalf; whether they can exercise a particular right depends on the circumstances, including the child’s understanding and any necessary authority.

14 Security

We take appropriate technical and organisational measures to protect personal information against unauthorised access, loss, misuse and disclosure. No website or transmission method is completely secure. Please protect your account access details and contact us promptly if you believe your account or information has been compromised.

15 Complaints

If you are unhappy with how we handle your information, contact us at sales@jakesbreaks.co.uk, by telephone on 01158 700 053, or at our postal address above. You do not have to use a particular form to complain.

We will acknowledge a data protection complaint within 30 days. We will investigate without undue delay, keep you informed as appropriate and explain the outcome.

You also have the right to complain to the Information Commissioner’s Office (ICO), the UK data protection regulator. Visit ico.org.uk/make-a-complaint. You do not need our permission to contact the ICO. Where another country’s data protection law applies, you may also have rights to complain to the relevant authority. EEA residents can find their authority through the European Data Protection Board’s directory.

16 Changes to this policy

We may update this policy when our services, use of information or legal obligations change. We will update the date above and bring significant changes to your attention where required. Updating this policy alone does not provide consent for a new use of information that requires your consent.
